In relation to a contract term, the requirement of reasonableness

A party to a contract "deals as consumer" in relation to another

In the case of goods of a type ordinarily supplied for private

Where for reliance upon it a contract term has to

Arbitration agreements
As against a person dealing as consumer, an agreement to submit

International supply contracts
The limits imposed by this Ordinance on the extent to which a
person
exclude or restrict liability by reference to a contract term do

The terms of an international supply contract are not subject to
any

For the purposes of this section, an international supply
contract

that is either a contract of sale of goods or a contract under

Where the proper law of a contract is the law of Hong Kong only

《丽江市地下水资源管理办法(试行)》已经2006年8月22日丽江市人民政府关于环境和资源保护专题会议通过,并于2006年7月26日经云南省法制办公室审查通过,准予登记,登记编号:云府248号。现予公布。

丽江市地下水资源管理办法(试行)
第一条 为加强地下水资源管理,有效保护、合理开发利用地下水资源,防止水污染和地质灾害,确保供水安全。根据《中华人民共和国水法》、《中华人民共和国水污染防治法》、《取水许可和水资源费征收管理条例》、《云南省实施〈中华人民共和国水法〉办法》等有关法律、法规,结合本市实际,制定本办法。
第二条 本办法所称地下水资源,是指储藏于地表以下包括地热水、矿泉水在内的各种类型的地下水。
本办法所称潜水是指地表以下第一个稳定隔水层以上,具有自由面的重力水。
本办法所称承压水是指第一个稳定隔水层以下的含水层中具有承压性质,不具有自由面的重力水。
第三条 在本市行政区域内,对地下水资源的勘探、开采、利用、保护和管理,适用本办法。
第四条 地下水资源属国家所有,不因其所依附的土地使用权不同而改变。未经水行政主管部门批准,任何单位和个人不得擅自开发和利用地下水资源。
第五条 市、区(县)水行政主管部门负责全市地下水资源的统一管理工作。国土资源、环境保护及建设主管部门按照职责分工,做好地下水资源勘察、监测、保护的有关工作。
第六条 一切单位和个人应当保护和节约地下水资源,有权检举、控告违法开采、破坏和污染地下水资源的行为。任何单位和个人都有保护和节约地下水资源的义务。
在地下水资源勘察、规划、保护、管理和科学技术研究等方面做出显著成绩的单位和个人,由市、区(县)人民政府给予表彰和奖励。
第七条 开采地下水资源应当遵循地表水与地下水统一调度、优先使用地表水、开源与节流并重、统一规划、采补平衡、有偿使用、防止污染的原则。
第八条 国民经济和社会发展规划以及城市总体规划的编制、重大生产建设项目布局,应当与地下水资源条件相适应,严格控制大量取用地下水的建设项目。
第九条 市、区(县)人民政府应当加强地下水资源监测站网的建设和管理。水行政主管部门应当会同有关部门科学编制本行政区域内地下水资源开发、利用、节约和保护的规划,负责地下水资源量、质的监测及评价工作,监督检查取用水单位和个人的取用水情况。
第十条 开采地下水资源,实行水资源论证制度,在探明的可开采限额内开采。
第十一条 开采地下水资源实行取水许可制度。
地下水取水行政许可,按管理权限,实行统一规划,集中审批,分级管理,加强保护的原则。
地下水取水许可,不得超过本行政区域地下水年度可采总量,并应符合井点总体布局和取水层位的要求。
家庭生活和零星散养、圈养畜禽饮用等取用潜水,日取水量不超过5立方米的,不需要办理取水许可证。但居民凿井取用承压水和开采地下水用于宾馆、客栈、餐饮、洗车等服务行业的除外。
第十二条 市、区(县)水行政主管部门应当根据本区域地下水资源开发利用现状,会同相关部门划定地下水资源超采区和严重超采区,报省人民政府批准并公告。
市、区(县)水行政主管部门对地下水超采区应当严格控制地下水开采指标,逐步削减开采量直至采补平衡。在地下水严重超采区,禁止开采地下水。对已批准开采的,应当限期核减开采量,直至停止开采。
第十三条 下列区域内严格限制开采地下水:
(一)城市规划区内市政供水管网覆盖且自来水供水满足需求的区域;
(二)风景名胜区;
(三)自然保护区;
(四)集中供水水源地保护区;
(五)地表水满足供水需求的区域;
(六)法律、法规规定的其他不宜取水的区域。
在以上限制区域内,严禁新开采地下水,对已开采承压水的水井,限期实施封填;对已开采潜水的水井,凡属应当办理取水许可的,限期补办取水许可有关手续,并限量取水。
第十四条 水行政主管部门根据用水定额,本地区地下水状况及上一级水行政主管部门下达的地下水年度取水计划,向取水单位和个人下达取水计划,对年度取水实行总量控制,并监督检查取水单位和个人用水计划的执行情况。
第十五条 取用地下水的单位和个人应当按照批准的取水量和用途取用地下水,需变更取水量和用途的,须经水行政主管部门审核同意。
第十六条 取水许可证不得转让。取水许可证登记事项发生变化的,被许可人应当到水行政主管部门办理变更手续。
第十七条 取得取水许可的单位和个人,必须严格遵守下列规定:
(一)建立健全取水井档案和用水管理制度;
(二)建立用水单位登记制度,如实填报用水报表;
(三)做好地下水水质年度监测工作;
(四)做好地下水水位日常监测工作。
第十八条 地下水资源实行有偿使用制度。
取用地下水的单位和个人,应当在批准的限额内取水并依法缴纳水资源费,超计划取水的,对超计划取水部分,按照云南省的规定加价征收地下水资源费;城市规划区范围内地下水水资源费征收标准按照云南省的规定,执行本城市供水平均价格。
第十九条 取水单位和个人必须安装符合国家标准的取水计量设施,并保证其正常运行和使用,不得擅自拆除更换。
第二十条 各级政府应当采取措施,推广节水工艺和节水设备,鼓励节水技术研究,积极推进节水型社会建设。
第二十一条 实行地下水取水许可证年度审验制度。
年度审验工作应包括以下内容:
(一)取水人法定代表是否变动;
(二)取水标的是否变化;
(三)取水量年内分配是否变化;
(四)取水工程(设施)安装的量水设施运行是否正常;
(五)节水设施、废污水处理设施运行是否正常;
(六)取水和退水地点是否变化;
(七)退水水质是否达到排放标准。
第二十二条 由水行政主管部门依据地表水及地下水资源功能区划定水源地保护区范围。在保护区范围内,禁止下列行为:
(一)设置渗水厕所、渗水坑、粪坑、垃圾场;
(二)堆放、填埋垃圾和有毒有害物质;
(三)排放工业废水和生活污水;
(四)法律、法规规定的其他行为。
第二十三条 地下水的水源地补给区和径流区,不得新建、改建和扩建有污染物排放的工业项目;不得设置生活垃圾、粪便和易溶有毒废弃物堆放场或者转运站。已建或者已设置的,应当限期治理、转产或者搬迁。
第二十四条 开采矿藏或者建设地下工程,必须对不同含水层进行止水封隔。
开采矿藏或者建设地下工程,因疏干排水导致地下水水位下降、水源枯竭或者地面塌陷,采矿单位或者建设单位应当采取补救措施;停采闭坑的,由水行政主管部门会同有关部门对地下水突水点采取的措施验收合格后,方可闭坑;对他人生活和生产造成损失的,依法给予补偿。
第二十五条 水文监测、地质勘探用于观测的钻孔应当分层止水;其余钻孔应当在勘探结束后封堵;作为监测和取用水的井应当做好永久性分层止水。
第二十六条 井内出现水浑、水位大幅度下降或者发生井台断裂塌陷、计量装置失灵等异常情况时,取用地下水的单位和个人应当立即停止取水,采取相应防护措施,并及时报告水行政主管部门。
第二十七条 报废、闲置或者未建成的水井,所属单位应当向水行政主管部门办理注销取水许可手续,并按照规定采取封填措施,防止地下水污染。
第二十八条 对实施封填的水井,封井费用由取水户承担。封井后须经水行政主管部门验收。在规定期限内未封井的取水户,依法吊销取水许可证,强行封井。
第二十九条 按照属地管理原则,封井工作由所在地人民政府负责实施,市、区(县)成立由水行政主管部门会同国土、建设、规划、环保、物价、发改、公安、工商、质量和技术监督、市政等部门组成的督查组,对封井工作进行严格督查。
第三十条 市、区(县)人民政府水行政主管部门或者其他有关部门及其工作人员,有下列行为之一的,由其上级行政机关或者监察机关责令改正;情节严重的,对直接负责的主管人员和其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任:
(一)对符合法定条件的取水申请不予受理或者不在法定期限内批准的;
(二)对不符合法定条件的申请人签发取水申请批准文件或者发放取水许可证的;
(三)违反审批权限签发取水申请批准文件或者发放取水许可证的;
(四)对未取得取水申请批准文件的建设项目,擅自审批、核准的;
(五)不按照规定征收水资源费,或者对不符合缓缴条件而批准缓缴水资源费的;
(六)侵占、截留、挪用水资源费的;
(七)不履行监督职责,发现违法行为不予查处的;
(八)其他滥用职权、玩忽职守、徇私舞弊的行为。
前款第(六)项规定的被侵占、截留、挪用的水资源费,应当依法予以追缴。
第三十一条 未经批准擅自取水,或者未依照批准的取水许可规定条件取水的,依照《中华人民共和国水法》第六十九条规定处罚;给他人造成妨碍或者损失的,应当排除妨碍,赔偿损失。
第三十二条 违反本办法第二十二、二十三条规定,造成地下水污染的,依照《中华人民共和国水污染防治法》的规定予以处罚。
第三十三条 未取得取水申请批准文件擅自建设取水工程或者设施的,依照《取水许可和水资源费征收管理条例》第四十九条规定处罚。
第三十四条 申请人隐瞒有关情况或者提供虚假材料骗取取水申请批准文件或者取水许可证的,依照《取水许可和水资源费征收管理条例》第五十条规定处罚。
第三十五条 拒不执行审批机关作出的取水量限制决定,或者未经批准擅自转让取水权的,依照《取水许可和水资源费征收管理条例》第五十一条规定处罚。
第三十六条 有下列行为之一的,依照《取水许可和水资源费征收管理条例》第五十二条规定处罚:
(一)不按照规定报送年度取用水情况及年度报表的;
(二)拒绝接受监督检查或者弄虚作假的;
(三)退水水质达不到规定要求的。
第三十七条 未安装计量设施、计量设施不合格或者运行不正常的,依照《取水许可和水资源费征收管理条例》第五十三条规定处罚。
第三十八条 取水单位或者个人拒不缴纳、拖延缴纳或者拖欠水资源费的,依照《中华人民共和国水法》第七十条规定处罚。
第三十九条 对违反规定征收水资源费、取水许可证照费的,由价格主管部门依法予以行政处罚。
第四十条 伪造、涂改、冒用取水申请批准文件、取水许可证的,依照《取水许可和水资源费征收管理条例》第五十六条规定处罚。
第四十一条 本办法自公布之日起施行。

第六十九条 有下列行为之一的,由县级以上人民政府水行政主管部门或者流域管理机构依据职权,责令停止违法行为,限期采取补救措施,处二万元以上十万元以下的罚款;情节严重的,吊销其取水许可证:
(一)未经批准擅自取水的;
(二)未依照批准的取水许可规定条件取水的。
第七十条 拒不缴纳、拖延缴纳或者拖欠水资源费的,由县级以上人民政府水行政主管部门或者流域管理机构依据职权,责令限期缴纳;逾期不缴纳的,从滞纳之日起按日加收滞纳部分千分之二的滞纳金,并处应缴或者补缴水资源费一倍以上五倍以下的罚款。

第四十九条 未取得取水申请批准文件擅自建设取水工程或者设施的,责令停止违法行为,限期补办有关手续;逾期不补办或者补办未被批准的,责令限期拆除或者封闭其取水工程或者设施;逾期不拆除或者不封闭其取水工程或者设施的,由县级以上地方人民政府水行政主管部门或者流域管理机构组织拆除或者封闭,所需费用由违法行为人承担,可以处5万元以下罚款。
第五十条 申请人隐瞒有关情况或者提供虚假材料骗取取水申请批准文件或者取水许可证的,取水申请批准文件或者取水许可证无效,对申请人给予警告,责令其限期补缴应当缴纳的水资源费,处2万元以上10万元以下罚款;构成犯罪的,依法追究刑事责任。
第五十一条 拒不执行审批机关作出的取水量限制决定,或者未经批准擅自转让取水权的,责令停止违法行为,限期改正,处2万元以上10万元以下罚款;逾期拒不改正或者情节严重的,吊销取水许可证。
第五十二条 有下列行为之一的,责令停止违法行为,限期改正,处5000元以上2万元以下罚款;情节严重的,吊销取水许可证:
(一)不按照规定报送年度取水情况的;
(二)拒绝接受监督检查或者弄虚作假的;
(三)退水水质达不到规定要求的。
第五十三条 未安装计量设施的,责令限期安装,并按照日最大取水能力计算的取水量和水资源费征收标准计征水资源费,处5000元以上2万元以下罚款;情节严重的,吊销取水许可证。
计量设施不合格或者运行不正常的,责令限期更换或者修复;逾期不更换或者不修复的,按照日最大取水能力计算的取水量和水资源费征收标准计征水资源费,可以处1万元以下罚款;情节严重的,吊销取水许可证。
第五十六条 伪造、涂改、冒用取水申请批准文件、取水许可证的,责令改正,没收违法所得和非法财物,并处2万元以上10万元以下罚款;构成犯罪的,依法追究刑事责任。
